23. DISPUTE RESOLUTION

All disputes, differences or questions concerning or connected with or in relation hereto the Website, these Terms and Conditions, the Agreement(s) or any transactions entered into on or through the Website or the relationship between You and www.astromudra.com (“Dispute”) or its subdomains, shall at the first instance be resolved through good faith consultation, which consultation shall begin promptly after a Party has delivered to the other Party with a written request for such consultation.

If the Parties are unable to resolve the Dispute within 30 Days of commencement of consultation proceedings, the dispute shall be submitted to and settled by way of Arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat for arbitration shall be New Delhi, India. The language used in the arbitral proceedings shall be English and all awards shall be made in the English language.
  3. The Parties shall mutually agree to choose 01 (one) person to be the sole arbitrator. In case no mutual agreement upon choosing such arbitrator is arrived at within a period of 30 days, the arbitrator shall be appointed per the terms of the Arbitration and Conciliation Act, 1996.
  4. The decision of the arbitrator shall be final and binding on the Parties and judgment may be entered thereon, upon the application of either Party to a court of competent jurisdiction. The award may include an award of costs, including reasonable attorney’s fees and disbursements.
  5. During the period of submission of arbitration and thereafter until the granting of the award, the Parties shall continue to perform all their obligations under this Agreement without prejudice to a final adjustment in accordance with such award, unless a stay over such obligations is granted to either or both parties under such arbitration proceeding or by a court of competent jurisdiction.

Any and all service of process and any other notice in any such claim, action or proceeding with respect to this Agreement shall be effective against a party if given as provided herein.

25. GENERAL TERMS

  1. Entire Agreement/Severability. These Terms of Use, together with the App Terms, Privacy Policy, and any amendments and any additional agreements you may enter into with www.astromudra.com , or its subdomains shall constitute the entire agreement between you and the platform If any provision of these Terms of Use is deemed invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms of Use will remain in full force and effect.
